Alliance for Energy Innovation, LLC (“Alliance”) is the managing and operating contractor of the National Laboratory of the Rockies (NLR) under Prime Contract No. DE-AC36-08GO28308 for the U.S. Department of Energy (DOE). By submitting media to Alliance (submitting to the “site”), you agree to be legally bound by the terms below.
For purposes of these terms, "you" and "your" mean you, individually as a natural person, and, if applicable, the organization on whose behalf you are submitting to the site, jointly and severally.
Alliance does not claim ownership rights in footage, data, audio, video, photos, graphics, images or other materials or content that you make available to Alliance ("media"). Media is owned by you unless otherwise provided herein or agreed by you in writing. Notwithstanding the foregoing, you hereby grant Alliance and the DOE a non-exclusive, worldwide, perpetual, irrevocable, fully paid up, royalty-free and transferable right and license, with the right to sublicense through multiple levels, to reproduce, adapt, copy, modify, create derivative works of, distribute, publicly perform, publicly display, digitally transmit, use for a commercial purpose, and otherwise use your media regardless of medium or format, whether now known or hereafter discovered. Further, you understand and agree that your media is accessible, downloadable and usable by members of the public to whom the media is made available by Alliance. You represent and warrant to Alliance that the media is your own original work, and that you have the right, title, and interest necessary in and to the media for such purposes, including that you have not and will not upload media depicting (a) natural persons, without such persons' express written permission, and persons under the age of majority or (b) third-party brands, logos or other proprietary information or intellectual property without the owner's permission. You represent and warrant to Alliance that the media will not include, endorse, or advocate content or features that would violate applicable laws or would be considered harmful, misleading, deceptive, fraudulent, unfair, immoral, indecent, pornographic, obscene, sexually explicit, excessively profane, racist, ethnically offensive, threatening, excessively violent, defamatory, hate speech, gambling, discriminatory, malware, illegal drugs or arms trafficking, alcohol, tobacco, prescription drugs, or weapons.
The media that you provide to Alliance and that Alliance provides on the site may be protected by U.S. and international copyright and other intellectual property laws and by other applicable laws, including privacy laws. You understand that Alliance is unable to provide you with permission to submit media for which you do not own the copyright or other intellectual property rights. You may not submit media without the written consent of the owner, and you are solely responsible for copyright or other intellectual property law violations that you may incur because of your submission of media to the site.
You agree to indemnify and hold Alliance and the DOE harmless for violations of this agreement. You agree to defend, indemnify and hold harmless the DOE, Alliance, NLR, its affiliates, licensors and service providers, and its respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees, including reasonable attorney’s fees, arising out of or relating to your media, your violation of these terms or your use of the site, and including, without limitation, use of the site, content, and services other than as expressly authorized in these terms or your use of information obtained from the site.
A joint venture, partnership, employment, or agency relationship does not exist between you and Alliance or the DOE because of these terms or use of the site.
